President Rajapakse appointed Judges of fraudulent military tribunal

The government produced Gen. Sarath Fonseka, who was illegally arrested and arbitrarily detained for more than a month before so-called military tribunals on the 16th and the 17th but failed to aim any genuine accusation against him. The present Army Commander Jagath Jayasuriya prepared charge sheets against the General and handed them over to the President. He handed over this process of the military tribunal to the brother-in-law of Jagath Jayasuriya adding to the tribunal two officers who had been punished by Gen. Fonseka for misappropriation to judge him.

All these appointments had been made by President Mahinda Rajapakse. It is very clear that the President was fully aware that he was appointing the brother-in-law of the present Army Commander and two other officers who had undergone disciplinary action during Gen. Fonseka’s tenure as the Army Commander to the military tribunal.

However, the government is now attempting to evade the responsibility of this situation. Minister Susil Premajayanthe speaking to ‘Dinamina,’ the official organ of the government on the 16th, the day the first of the military tribunals was held, has said, “Mr. Sarath Fonseka was not arrested by the government. It was the Military Police that arrested him stating there were certain allegations against him.”

However much the President and the government attempt to evade the responsibility of arresting Gen. Fonseka and arbitrarily keeping him under detention, it is difficult to hide that it’s the President who has appointed the brother-in-law of the present Army Commander and two officers who had been found guilty of malpractice as the judges of the military tribunal to try Gen. Fonseka.
